Acceptable Use Policy.
What you may not do with FJV Tech's products and services — including Chately — so they stay safe, lawful and reliable for everyone.
Last updated:
1. Purpose and scope
This Acceptable Use Policy (“AUP”) applies to everyone who uses a website, application, API or other service provided by FJV Tech LLC, including Chately (together, the “Services”). It forms part of the terms you accepted for each Service. If a Service’s own terms include a more specific acceptable-use policy, that policy prevails for that Service.
You are responsible for your own use of the Services and for the use by anyone you give access to — your team members, contractors and integrations.
2. Messaging and communications
Several of our Services let you send messages to your own customers (for example, through the WhatsApp Business Platform). When you do, you must:
- only message people who have given you the consent required by law and by the messaging platform, and honor opt-out requests promptly;
- comply with the WhatsApp Business Messaging Policy, WhatsApp Commerce Policy and Meta’s terms, as well as the rules of any other channel you connect;
- comply with applicable anti-spam, telemarketing and consumer-protection laws (such as the U.S. TCPA and CAN-SPAM, and equivalent laws where your recipients live);
- clearly identify your business and never send deceptive, misleading or impersonating messages.
You may not use the Services to send bulk unsolicited messages, purchase or use scraped contact lists, or evade limits or quality controls set by us or by a messaging platform.
3. Prohibited content
You may not use the Services to create, store, send or distribute content that:
- is illegal, or promotes or facilitates illegal activity, goods or services;
- sexually exploits or endangers minors in any way;
- is defamatory, harassing, threatening, hateful, or incites violence against people based on protected characteristics;
- infringes intellectual-property, privacy or publicity rights of others;
- constitutes fraud, phishing, pyramid schemes or other scams;
- contains malware, ransomware or any malicious code;
- discloses sensitive personal data (such as health, financial or government ID data) without a lawful basis and appropriate safeguards.
4. Prohibited activities
You may not:
- access or attempt to access accounts, data or systems you are not authorized to use, or probe, scan or test the vulnerability of the Services without our written permission;
- interfere with, overload or disrupt the Services or their infrastructure, including through denial-of-service attacks or abusive automated traffic;
- reverse engineer, decompile or attempt to extract the source code of the Services, except where the law expressly allows it;
- resell, sublicense or provide the Services to third parties as a service bureau, unless your agreement with us allows it;
- circumvent usage limits, billing, authentication or security controls;
- use the Services or their outputs to build a competing product, or to train machine-learning models, without our written consent;
- use the Services’ AI features to generate content that violates this AUP or the policies of the underlying AI providers, or present AI-generated content as human-authored where the law requires disclosure.
5. Security and vulnerability reporting
If you discover a security vulnerability, please report it privately to [email protected] with enough detail for us to reproduce it, and give us reasonable time to fix it before any disclosure. We appreciate good-faith research that avoids privacy violations, data destruction and service disruption.
6. Enforcement
We may investigate suspected violations of this AUP. Depending on the severity, we may remove content, suspend or restrict features, suspend or terminate accounts, and report activity to law enforcement or affected platforms (such as Meta). Where reasonable, we will notify you and give you an opportunity to fix the issue first, but we may act immediately to protect the Services, our customers or the public.
We are not obligated to monitor your use of the Services, and our failure to enforce this AUP in one case does not waive our right to do so in another.
7. Reporting abuse
To report a violation of this AUP, email [email protected] with as much detail as possible (links, screenshots, phone numbers, dates).
8. Changes
We may update this AUP to address new risks or legal requirements. The “Last updated” date shows the current version.
